Privacy Policy

Our commitment

ACTIV8 by JT ("we") respects your privacy and handles your personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). This policy explains what we collect, why, how we use and protect it, who we share it with, and your rights. By providing your personal information to us, or by purchasing or using our services, you agree to your information being handled as described in this policy.

Information we collect

Depending on the service, the personal information we may collect about you includes:

  • Identity & contact details: your name, email, phone, postal/billing address, and (if you choose) social media handles.
  • Age confirmation: confirmation that you are at least 18 years old, and your date of birth where relevant.
  • Payment information: billing details and transaction records. Card payments are processed by our third-party payment provider — we do not store your full card numbers.
  • Health & fitness information (sensitive information): age, weight, body measurements, body-fat, training history, injuries, medical conditions, medications, allergies, food preferences, goals, supplement use, sleep, steps and habits (see the Sensitive (health) information section).
  • Progress data & media: weigh-ins, progress photos, measurements, check-ins and form-check videos.
  • Account & usage data: information from the coaching app, intake forms, surveys, messages and your interactions with us.
  • ACTIV Women activity and community data: connected step and activity totals, device-sync status, leaderboard position, milestones and rewards, app-resource access, community profile information, posts, reactions and group messages.
  • Trial and subscription data: trial start and end dates, acquisition path, payment-method status, subscription status, billing dates, cancellations and access history. We do not store your full card number.
  • Technical & website data: device and browser type, operating system, IP address, approximate location, pages viewed, the source you arrived from, and similar analytics data collected through cookies and similar technologies (see the Cookies & website analytics section).
  • Marketing data: if you opt in, your responses to lead magnets, surveys and campaigns.
  • Any other information you choose to provide, or that we reasonably request, in connection with our services.

How we collect it

We collect information in several ways:

  • Directly from you — at checkout, through onboarding and feedback forms inside the coaching app (Everfit), via uploaded photos and measurements, through community posts, messages/DMs, surveys, and during check-ins.
  • Automatically from connected services and devices — where you choose to connect a phone, watch or health/activity service to Everfit, we receive the activity data and connection status made available through that integration. You can disconnect a device, but this may prevent step tracking, leaderboard participation or milestone verification.
  • Automatically — through cookies and analytics tools when you use our website (see the Cookies & website analytics section).
  • From third parties — for example social media platforms, people who refer you, or (only with your consent) a healthcare provider such as your GP.

Where you give us another person's personal information (for example a partner on the partner rate, or an emergency/health contact), you confirm that you have their consent to provide it and for us to handle it as described in this policy.

Sensitive (health) information

Health information is "sensitive information" and is given a higher level of protection under the APPs. We mainly collect it through your health assessment questionnaire and your ongoing check-ins, and it may include your height and weight, medical history, medications, injuries, food and nutrition intake, and allergies or food preferences. We only collect sensitive information with your consent, and we use and disclose it solely for the purpose for which it was collected — to deliver your coaching, meal plans and personalised nutrition safely and effectively — or as required or authorised by law. You can decline to provide certain information, but this may limit our ability to coach you safely.

ACTIV Women, connected steps and community privacy

  • ACTIV Women is a community membership rather than private one-on-one coaching. Information you post in its forum, group chat or leaderboard may be visible to other current members. Do not post medical details, private contact information or anything you do not want other members to see.
  • Connected step totals, milestone status and leaderboard information are used to operate the self-paced challenge, recognise progress, verify rewards and prevent misuse. We do not use connected activity data to make medical decisions.
  • Private health assessments, progress photos, direct messages and payment information are not intentionally published to the community. Public use of a testimonial, result or transformation image still requires separate express consent.
  • Website and paid-ad members may provide a payment method to Stripe for a four-week trial that automatically continues at A$40/month unless cancelled. Stripe handles card details; we receive subscription and transaction status needed to administer access, reminders, renewals and cancellations.
  • Personally invited no-card trial members are not charged unless they later expressly agree and provide payment details. We may retain their account and trial history for reasonable follow-up, record keeping and reactivation, subject to deletion requests and legal obligations.

Why we collect and use it

We collect, hold and use your information to:

  • Provide, personalise and adjust your coaching, plans and programs;
  • Verify your identity and manage your account, trials, subscriptions, billing, cancellations and minimum terms;
  • Operate ACTIV Women community features, connected step tracking, leaderboards, milestone recognition and rewards;
  • Verify progress and, for a Challenge, judge results fairly;
  • Process payments and recover any amounts owing;
  • Communicate with you (coaching feedback, reminders, service updates and replies to enquiries);
  • Run competitions, offers and referrals;
  • Operate, analyse and improve our services, website and marketing;
  • Send you marketing only if you have opted in (you can opt out at any time); and
  • Meet our legal, tax and record-keeping obligations and resolve disputes.

We will ask for your consent if we need to use your information for a purpose that is not described in this policy.

Who we share it with

We do not sell your personal information. We share it only as needed with:

  • Service providers who help us operate — for example Stripe (payments), Everfit (coaching app, onboarding and feedback forms), cloud/hosting and storage providers (e.g. Google, Netlify), and email, messaging and analytics providers;
  • Professional advisers such as our accountant or lawyer, where necessary;
  • Debt collectors and credit-reporting bodies, if you fail to pay for services we have provided to you;
  • A purchaser or successor, if we sell or transfer all or part of our business or assets;
  • Sponsors or promoters connected with a competition we run; and
  • Courts, tribunals, regulators and law enforcement, where required or authorised by law or to establish, exercise or defend our legal rights.

Overseas disclosure

Some of our providers may store or process your information outside Australia. Where we disclose information overseas, we take reasonable steps to ensure it is handled consistently with the APPs. However, overseas recipients may not be regulated by the Privacy Act, and you acknowledge that we are not accountable for them under the Privacy Act and you may not be able to seek redress under the Act if such a party mishandles your information.

Marketing & testimonials

We will only use your photos, results or testimonials publicly with your express, separate consent. Consent applies to uses already created, published, distributed or committed in accordance with that consent. A later request to stop new public use does not require us to recall, delete or remove material already lawfully published, distributed, printed, included in a completed or committed campaign, or retained as a legal, competition or consent record. We will stop new uses within a reasonable time where required by law. Marketing-message opt-outs remain separate and do not affect coaching already purchased.

Cookies & website analytics

When you visit our website (activatebyjt.com.au), we and our providers may use cookies and similar technologies to keep the site working, remember your preferences, understand how the site is used, and show you relevant ads — for example through tools like Google Analytics or the Meta (Facebook) Pixel. You can control or disable cookies in your browser settings, although some parts of the site may not work as well. Where the law requires it, we will ask for your consent before using non-essential cookies.

Anonymity & pseudonymity

Where it is lawful and practicable, you have the option of dealing with us anonymously or by using a pseudonym — for example when making a general enquiry. However, we usually cannot provide coaching safely or process payments without knowing who you are.

Data security

We take reasonable physical, electronic and managerial steps to protect your information from misuse, interference, loss and unauthorised access, modification or disclosure. No method of transmission over the internet is completely secure, so while we work hard to protect your information, we cannot guarantee the security of information you transmit to us, and any transmission is at your own risk. If a data breach occurs that is likely to result in serious harm, we will respond in line with the Notifiable Data Breaches scheme.

Data retention

We keep your personal information only for as long as needed to provide the services and to meet our legal, tax and accounting obligations. Cancelling ACTIV Women ends future billing but does not necessarily delete your account or records immediately. We may retain subscription, transaction, consent, cancellation, community-moderation and reward records for legitimate business and legal purposes, and may retain app history for a reasonable period to support a return. To decide how long to keep information, we consider its amount, nature and sensitivity, the risk of harm, and the purpose for which it is held. When it is no longer needed, we take reasonable steps to delete or de-identify it. We may keep de-identified information indefinitely for analytics and research.

Accessing, correcting & deleting your information

You can ask to access or correct the personal information we hold about you, or ask us to delete it (subject to our legal obligations), by contacting us at info@activatebyjt.com.au. We will respond within a reasonable time and may need to verify your identity first. If you believe any information we hold is inaccurate, out of date or incomplete, we will take reasonable steps to correct it.

Links to other websites

Our website and content may contain links to third-party websites and platforms that we do not control. We are not responsible for the privacy practices or content of those sites, and we encourage you to read their privacy policies.

Children's privacy

Our services are intended for adults. We do not knowingly collect personal information from anyone under 18 years of age, and we do not coach or provide services to people under 18. If you believe we have collected personal information from a person under 18, please contact us at info@activatebyjt.com.au and we will take reasonable steps to delete it.

Your consent & acceptance at checkout

By providing your personal information, purchasing a service, or completing checkout, you consent to us collecting, holding, using and disclosing your personal information as set out in this policy, and you confirm you have read and agree to our <mention-page url="https://app.notion.com/p/7eea16772945836b811a01d99c85da93"/> and this Privacy Policy. At checkout you will be asked to tick a box confirming this before your purchase is completed. You do not have to provide your personal information, but if you don't, we may not be able to provide our services to you.

International clients

We operate from Australia and handle your personal information under the Australian Privacy Principles. If you access our services from outside Australia, you do so on your own initiative and are responsible for complying with your local laws. If you are located in the European Union or the United Kingdom, you may have additional rights under the EU/UK General Data Protection Regulation (GDPR), including the rights to access, correct, erase, restrict or object to the processing of your personal information, and to data portability. To exercise any of these rights, contact us at info@activatebyjt.com.au and we will respond to the extent those laws apply to us.

Complaints

If you have a privacy concern, contact us first at info@activatebyjt.com.au and we will work to resolve it promptly. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
